These terms cover groupbuys.io, the Groupbuys Discord bot and the Groupbuys Discord server (together, the “Service”), run by Groupbuys (“we” or “us”). By signing in, adding the bot or joining the server, you agree to them and to our Privacy Policy. If you don’t agree, don’t use the Service.

Groupbuys is not affiliated with or endorsed by Discord Inc.

1. Who can use Groupbuys

You must be old enough to use Discord where you live, and at least 13. You must also follow Discord’s Terms of Service and Community Guidelines. You sign in with your Discord account and are responsible for what happens under it.

2. What the Service does

Groupbuys helps owners of Discord servers find each other and trade ads. Owners list a server, send and negotiate partnership requests, and the bot carries out what both sides accept: posting ads, and any agreed pings, pins, repeat posts or giveaways.

Signing in adds you to the Groupbuys Discord server and lets us add you back to it, or to servers it partners with, later. You can turn that off in your account menu.

3. Listing a server and using the bot

• You may only list servers you own, and you must keep your listing accurate.
• Adding the bot allows it to read server details, create and manage the channels it uses, and post in them. Removing the bot stops this, and can end your listing and any partnerships that depend on it.
• You are responsible for your server, and for telling your members about anything your server’s rules or local law require you to, including paid or promotional content.

4. Ads and partnerships

Partnerships are agreements between server owners. We deliver what the bot is able to deliver, but we aren’t a party to those agreements, don’t guarantee any number of members or results, and aren’t responsible for what another owner does or doesn’t do. Discord can also refuse or limit what the bot does.

You are responsible for your ads and profile. They must not:

• break the law or Discord’s rules, or promote scams, malware, phishing or stolen goods;
• contain sexual content involving minors, hate, harassment or threats;
• mislead people about your server, or infringe someone else’s rights.

You keep ownership of your content. You give us permission to store, display and post it as needed to run and promote the Service, including showing listings publicly and announcing them in the Groupbuys Discord server.

5. Giveaways

Giveaways agreed in a partnership are run by the server owners who set them up. Those owners supply the prizes, deliver them, and are responsible for following any laws that apply. We only run the entries and the draw.

6. Groupbuys Tokens

Groupbuys Tokens are a points system for the Groupbuys Discord server. They have no cash value, can’t be bought, sold or exchanged for money, and aren’t your property. Bets, rumbles and lotteries use tokens only, never real money. We may change how tokens work, and may remove tokens that were earned by breaking the rules or by mistake.

7. Rules of conduct

Don’t misuse the Service. That includes using alt accounts or scripts to earn tokens or win giveaways, scraping it, getting around its limits, interfering with it, or using it to spam people.

8. Suspension and ending

You can stop at any time: unlist your server, remove the bot, and remove the Groupbuys app from your Discord account. We may remove a listing or ad, cancel requests, or suspend or ban you from the Service or the Discord server if we believe you broke these terms, or if we need to in order to protect the Service or other people. We may also change or end the Service.

9. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We don’t promise it will be uninterrupted or error free, or that posts will always go out on time.

10. Limit of liability

To the fullest extent the law allows, we aren’t liable for indirect or consequential losses, or for lost members, profits, data or goodwill. Our total liability for any claim is limited to US$50. Some places don’t allow these limits, so they may not fully apply to you.

11. Indemnity

If someone makes a claim against us because of your content, your server or your breach of these terms, you agree to cover the resulting losses and reasonable costs, to the extent the law allows.

12. Disputes

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws rules. Any dispute will be settled by binding individual arbitration under the rules of the American Arbitration Association, held in New Jersey unless we agree otherwise. Either of us may instead bring an individual claim in small claims court. You agree to bring claims only in your individual capacity, not in a class or representative action. Nothing here removes rights you have under mandatory consumer law where you live.

13. Changes to these terms

We may update these terms and will change the date at the top when we do. For significant changes we’ll also give notice on the site or in the Groupbuys Discord server. Continuing to use the Service after that means you accept them.
